The aim of this structure is not to motivate animals' creativity, but to safeguard it - the monkey selfie case ended in an out of court settlement of which the animal in question was not even a part.
Of course creativity and AI are pressing concerns-the future is here, and we are not ready for it. However, this issue is equally real-there may not be a Planet of the Apes-like situation tomorrow, but PETA claiming independent creation of an animal's version of Shakespeare is really not a stretch, going by how it jumped into the monkey selfie situation.Iravatinoreply@blogger.comtag:blogger.com,1999:blog-5574479.post-81732661825209601912019-07-19T18:02:52.461+01:002019-07-19T18:02:52.461+01:00I guess that 1st April was too far away for you to...I guess that 1st April was too far away for you to hold this piece over, or perhaps Merpel just thought we all needed a good laugh in these politically constipated times.

Nature is full of wonderful and wonderous things which we humans can admire, but that doesn't mean we have to turn everything into Bitcoin or work for lawyers. The authors offer no real justification for their proposal beyong the fact that some wildlife park can generate a new income stream for its gift shop. Whether you approach a right such as copyright or its sui generis avatar from a utilitarian or a droit d'auteur route, there is no justification giving humans an economic right over a natural form of creation which requires neither money nor prestige as a motivating force. Are the bower birds going to stimulated into making more and better nests just because they know that will help their human friends make more money? I would love to be in court the day that counsel have to argue that the large number of monkeys who are his clients claim independent creation of their version of the complete works of Shakespeare.

Let's sort out how we are going to tackle creativity and AI before we embark on flights of fancy in which the animal kingdom aspires to hold its own Turner or Stirling Prize competition.
