I'm not a specialist on competition law, but I find it quite loosely worded, and often it seems that for the big companies the proactive interest by the Commission (and the equivalent anti-trust authorities in the US) means a lot of self-regulation happens. Having drafted patent applications for a large pharma company it was interesting to see how much concerns about perceived anti-competitive behaviour affected the contents of the applications. I think in this area at least the Commission seems to be getting it right.Anonymousnoreply@blogger.com
