Stem cell patent

The Washington Post reports that the USPTO has revoked three patents granted to Wisconsin Alumni Research Foundation for inventions involving human embryonic stem cells. The Foundation has said that it will appeal, and the governor of Wisconsin has said that it will back the Foundation.

The IPKat notes that a patent involving stem cells filed by the same organisation is currently before the EPO Enlarged Board of Appeal.

    The USPTO has not revoked the patents. The patents are undergoing re-examination. The USPTO has issued Actions rejecting all claims of the 3 patents. WARF has yet to respond. The outcome has not been decided yet. My understanding is that if the patents are revoked, WARF will appeal

    WARF gave us Warfarin. Originally it killed rodents but since they have become resistant it is widely dispensed to humans.
