On 26 January 2024, the Unified Patent Court (UPC) and Italy signed the formal agreement on the Headquarters of the third seat of the UPC Central Division in Milan. The finalization of the agreement was announced with a press release by the Italian Ministry of Foreign Affairs. The agreement was signed in Milan between the Italian Ministry of Foreign Affairs and the UPC, represented by the President of the UPC Court of Appeals, Klaus Grabinski.
The headquarters’ Agreement follows the
decision of the Administrative
Committee of the Unified Patent Court of June last on the creation of
the Milan seat of Central Division to replace the former London section (see The
IPkat here
and here).
The Milan seat will start its operations on 1st
June 2024 and will have jurisdiction over patent disputes in the “human
necessities” sector, thus including pharmaceutical and medical device
industries, agricultural industry, food industry, tobacco industry, home
appliances industry, clothing industry, wood and furniture industry,
fire-fighting industry, sports and gaming industry.

Could anybody tell me what is the legal basis of the formal agreement on the Headquarters of the third seat of the UPC Central Division in Milan?
ReplyDeleteHow can it be that a court purposedly ignores the terms of the treaty under which it has been set up?
Art 87(2) UPCA has also been flagrantly misused. It was never concieved to adapt a treaty without any exit clause to the "withdrawal" of the UK!
Two questions, asking for a friend: (1) What is the actual court room that he UPC will use? (I really hope it is not the 1930's style building in Milan where patent cases are currently held, as that building is not fit for purpose in the modern age); (2) Are there any details of the judges that have been appointed to this seat of the Central Division?
