TW OCTOBER 2004

The October 2004 issue of Informa's ten-time-a-year Trademark World leads with a feature by B. Brett Heavner and Naresh Kilaru (Finnegan Henderson) on the Idaho Potato Commission case, a US dispute involving the doctrine of licensee estoppel and its applicability where the mark licensed is a certification mark rather than just an ordinary trade mark. Other pieces of interest include

* "Extracting Value" by Michael Stirling (Field Fisher Waterhouse), on the rise of trade marks as a key financial indicator of the value of a company;

* "The Razor's Edge" by Bardehle Pagenberg's Claus Eckhartt - a review of the international litigation in Philips v Remgington over the three-headed shaver configuration and its defining role in the European law on shape marks;

* "Pitfalls of Tomorrow" by Lisa Rovinsky and Kathleen Heberlein (Alston & Bird) on the currently sexy topic of online advertising practice versus trade mark rights.

Comments will not be allowed if the contravene the IPKat policy that readers' comments should not be obscene or defamatory; they should not consist of ad hominem attacks on members of the blog team or other comment-posters and they should make a constructive contribution to the discussion of the post on which they purport to comment.

It is also the IPKat policy that comments should not be made completely anonymously, and users should use a consistent name or pseudonym (which should not itself be defamatory or obscene, or that of another real person), either in the "identity" field, or at the beginning of the comment. Current practice is to, however, allow a limited number of comments that contravene this policy, provided that the comment has a high degree of relevance and the comment chain does not become too difficult to follow.
