IPKat co-blogmeister Ilanah has written an article entitled ‘Embellishment: Trade Mark Use Triumph or Decorative Disaster’. The article examines the concept of embellishment introduced by the ECJ in Case C-408/01 Adidas v Fitnessworld and asks whether it introduces a trade mark use requirement into EU dilution-style protection.
