DATABASE CASE IN THE OFFING?

According to Business Wire, Jupitermedia has sent a cease and desist letter to data aggregator eMarketer Inc. Jupiter is claiming inducement to breach contract and infringement of its copyright and database rights in both France and the United Kingdom against eMarketer, a company that claims to aggregate data from many sources, but does not have a licence from Jupiter. Jupiter is already bringing trade mark and copyright actions against eMarketer in the US. “Simply calling yourself an 'aggregator' does not permit one to steal another's proprietary research and trade marks and sell them as your own," said JupiterMedia’s chairman and CEO.

The IPKat waits to see whether these parties will end up in court.
