More trade mark woe for Nestle’s KIT KAT bar. While last week’s HAVE A BREAK decision has been widely publicised, it’s less well known that Nestle applied to have the shape of the KIT KAT bar registered as a Community trade mark. The decision is only available in French but, from what the IPKat can make out, the Board of Appeal upheld the decision not to register the shape on grounds of lack of inherent and acquired distinctiveness.

The IPKat notes that though the shape was not found to have acquired distinctiveness, when he saw a decision entitled FORME DE QUATRE BARRES DE CHOCOLAT, he thought “Oooh, that must be KIT KAT”. He leaves readers to draw their own conclusions.
